Terms of Service

1. Service Description

Klarity is a business operations platform provided by Black Bridge GmbH ("we", "us", "our"), offering task management, scheduling, time tracking, CRM, and related features. By creating an account, you agree to these terms.

2. Account Terms

• You must provide accurate information when creating your account via Google OAuth.
• You are responsible for maintaining the security of your account and any activity that occurs under it.
• Each workspace is intended for a single organization. You may create multiple workspaces if needed.
• You must be at least 16 years old to use Klarity.

3. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorized access to any part of the service or its related systems.
• Interfere with or disrupt the integrity or performance of the service.
• Use automated tools to scrape, crawl, or otherwise extract data from the service beyond what is permitted by the API.
• Resell, sublicense, or redistribute access to the service without our written consent.

4. Free Trial and Billing

• New workspaces receive a 14-day free trial with access to all features.
• After the trial period, a paid subscription is required to continue creating and modifying data. Read access remains available.
• Billing is handled through our payment provider, Polar. Subscription details and pricing are displayed at checkout.
• You may cancel your subscription at any time through the billing portal. Access continues until the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions are honored until the end of their current term.

5. Data Ownership

• You retain full ownership of all data you enter into Klarity.
• We do not claim any intellectual property rights over your content.
• You grant us a limited license to store, process, and display your data solely for the purpose of providing the service.
• You may export your data at any time. Upon account deletion, your data is permanently removed within 30 days.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. The service is provided on an "as is" and "as available" basis.

7. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
• We are not responsible for data loss due to circumstances beyond our reasonable control, though we maintain regular backups.

8. Termination

• You may delete your account at any time from your workspace settings.
• We may suspend or terminate your account if you violate these terms, with notice where practicable.
• Upon termination, your data is retained for 30 days to allow recovery, then permanently deleted.

9. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. The courts of Darmstadt, Germany shall have exclusive jurisdiction over any disputes arising from these terms.
